This End User License Agreement (“Agreement,” “EULA”) is a legal contract between you (“User,” “you,” or “your”) and Zephkyr App LLC (“Company,” “we,” “our,” or “us”), governing your use of the Zephyrind mobile application, website, and related digital services (collectively, the “Platform”).
By downloading, installing, or using the Platform, you confirm that you have read, understood, and agreed to this Agreement. If you do not agree, you must not use the Platform.
1. License Grant
- We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial purposes related to browsing, purchasing, and reviewing self-care and beauty products.
- All rights not expressly granted remain with Zephkyr App LLC.
2. Restrictions on Use
You agree not to:
- Copy, modify, reverse-engineer, or distribute any part of the Platform.
- Use the Platform for unlawful, fraudulent, or harmful purposes.
- Circumvent security features or attempt unauthorized access to data.
- Resell or commercially exploit the Platform or its content without prior written consent.
3. Ownership & Intellectual Property
The Platform, including its software, design, content, trademarks, and branding, is owned by Zephkyr App LLC or its licensors. This Agreement does not transfer any ownership rights to you.
4. Account Responsibilities
- You may be required to create an account to access certain features.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate and updated information.
5. Purchases & Transactions
- Any purchase made through the Platform is governed by our Terms & Conditions and Refund & Returns Policy.
- All transactions are processed securely through trusted third-party payment providers.
6. Updates & Modifications
- We may provide updates, patches, or enhancements to improve the Platform.
- Continued use after updates implies acceptance of those changes.
- Some updates may be mandatory for continued functionality.
7. Termination
We may suspend or terminate your license immediately, without prior notice, if you violate this Agreement. Upon termination, you must stop using the Platform and uninstall any copies from your devices.
8. Disclaimers
- The Platform and its services are provided “as is” and “as available” without warranties of any kind.
- We do not guarantee uninterrupted access, error-free operation, or absolute security.
- Product information provided is based on manufacturer or supplier details and may not always be exhaustive.
9. Limitation of Liability
To the maximum extent permitted by law, Zephkyr App LLC shall not be liable for indirect, incidental, or consequential damages arising from your use or inability to use the Platform, including but not limited to loss of data, profits, or goodwill.
10. Indemnification
You agree to indemnify, defend, and hold harmless Zephkyr App LLC, its affiliates, and employees from any claims, damages, or liabilities arising out of your misuse of the Platform or violation of this Agreement.
11. Governing Law & Dispute Resolution
- This Agreement shall be governed by the laws of the State of California, United States.
- Any disputes shall be resolved exclusively in state or federal courts located in San Francisco, California.
12. Changes to This Agreement
We may revise this EULA at any time. Updated versions will be posted on the Platform with the “Effective Date.” Continued use after updates constitutes acceptance of the revised Agreement.
